Teliqon Legal Information

This Acceptable Use Policy (“AUP”) is incorporated by reference in Your Agreement with Teliqon and describes activities that are not allowed in connection with Your and Your Authorized User(s) use of Teliqon Services.

By using Teliqon Services, You agree to adhere to this AUP and any related agreements and policies.

Capitalized terms used in this Acceptable Use Policy shall have the meaning given in the Agreement unless otherwise defined herein. 

1. Unlawful activities against Teliqon
   You and Your Authorized User(s) shall not:

   • a) license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, share or otherwise commercially exploit or make Teliqon Services available to any third party, other than Authorized User(s) in a way as expressly permitted by the Agreement; 

   • b) modify, adapt, or hack Teliqon Services or otherwise attempt to gain unauthorized access to Teliqon Services or related systems or networks;

   • c) “crawl,” “scrape,” or “spider” any page, data, or portion of or relating to Teliqon Services (through use of manual or automated means);

   • d) introduce malicious software, viruses, or other harmful content;

   • ​​e) change or delete any of our ownership notices from Teliqon Services portal or Account;

   • f) access or use Teliqon Service(s) for purposes of creating derivative works based on, or developing or operating products or services for third parties in competition with Teliqon Services.

2. Unlawful activities while using Teliqon Services
   While using Teliqon Services You and Your Authorized User(s) are prohibited to:

   • a) Conduct or engage in any unlawful or fraudulent activities. In particular, You and Your Authorized User(s) shall not: 
     
     

     • - engage in activities that violate any applicable laws or regulations, whether local, provincial, national, or international;

     • - transmit, distribute, or store any materials and data, including Personal Data, in violation of any applicable law or regulation;

     • - impersonate any person or entity or misrepresent Your affiliation with a person or entity;

     • - engage in fraudulent activities such as phishing, identity theft, or financial scams;

     • - use Teliqon Services to transmit or store any content or communication that is illegal, exploitative, abusive, harmful, unwanted, deceptive, inappropriate, or objectionable in the recipient’s jurisdiction (including, content or communications which Teliqon determines (i) is false or inaccurate; (ii) is hateful or encourages hatred or violence against individuals or groups or encourages terrorism or violent extremism; (iii) could endanger public safety, (iv) describes, features or promotes graphic violence, or (v) the sale or promotion of prohibited substances or goods).

   • b) Conduct or engage in any unsolicited communications, in particular: 
     
     

     • - collect, process, transmit or share information about third parties, including phone numbers, without their consent if such is required under applicable legislation;

     • - send or facilitate the sending of unsolicited bulk communications, including but not limited to SMS, or robocalls, except when meeting legal standards for call center traffic;

     • - use Teliqon Services for sending spam, opt-in or unsolicited email, port scanning, scanning for open proxies or open relays, attacking in any way, shape, or form any other computer or network;

     • - expose any third party to material that is offensive, harmful to minors, indecent or otherwise objectionable in any way, regardless of whether such activity is lawfully permitted (including, content or communications which Teliqon determines such content or communication describes, features, or promotes (i) child sexual exploitation or abuse, or used for purposes of grooming children, (ii) non-consensual intimate activity or human trafficking, (iii) sexual solicitation, or (iv) suicide or self-injury).

   • c) Conduct or engage in any harmful behavior against other Teliqon Customers, in particular:
     
     

     • - disrespect other Customers and Authorized User(s) or violate their rights in any way;

     • - use Teliqon Services in a way that negatively impacts other customers' ability to use Teliqon Services.

1. You are required to implement reasonable security measures to protect Your systems, applications, and networks from unauthorized access or use. This includes, but is not limited to, using firewalls, anti-virus software, and strong, complex passwords.

1. Should You become aware of any violations of this AUP, please notify us via oi.noqilet@eciffo. We will investigate and may take appropriate action in accordance with this AUP.

1. Teliqon reserves the right, at its sole discretion, to suspend or terminate Your access to Teliqon Services, block data transmission, or take other appropriate actions if we believe You or any of Your Authorized User(s) are in violation of this AUP.
2. Teliqon may cooperate with law enforcement and other authorities in investigating claims of illegal activity or violations of this AUP. This may include disclosing information about You or Your use of Teliqon  Services to government authorities as required by law.

1. Teliqon shall not be liable for any damages arising from Your use of Teliqon Services in violation of this AUP, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

1. Teliqon may modify this AUP at any time by posting a revised version on the Teliqon Website. Your continued use of Teliqon Services after such changes constitutes Your consent to the updated AUP.
